It is widely known that standard patent is praised as the diamond patent. According to the Provisional Regulations of National Standard on Patent issued by the Standardization Administration of the P.R.C. (SAC) and the China National Intellectual Property Administration (CNPIA), the patent involved in a National  Standard should be the essential patent, i.e., the patent is essential to implementation of that standard. It significantly shows the importance of standard patent, especially in fields of communications in which standard patent is even more one of industry criterions.
       Standard patent also has different sorts. So far, incopat has processed standard information of ETSI (European Telecommunications Standards Institute) and ITU (International Telecommunication Union). According to incomplete statistics, now China has 13,876 standard patents of the above mentioned sorts and 60% of them belong to two companies Huawei and ZTE who respectively have 5,510 and 2,715 standard patents. 
       The importance of the standard patent puts some special requirements for the drafting of the application documents. Currently, the IP firms that handle standard patents for Huawei mainly are Leader IP, Longsun Lead IP, and, TDIP & PARTNERS, and the ones that handle standard patents for ZTE mainly are Kangxin Partners P.C., AFD China Intellectual Property, and, China PAT Intellectual Property Office.
